Business Interruption (BI): Covid-19: FCA BI test case appeal

On Friday 2nd October, the High Court gave its permission for the appeals process in the FCA’s test case to ‘leapfrog’ to the Supreme Court. Certificates for an appeal were granted to the following:

The next step toward an appeal being formally made, is for these parties to apply to the Supreme Court for permission to appeal.

The FCA have stated that they will review the final declarations following the consequentials hearing at the High Court on the 2nd October, and decide on its next steps which include moving ahead with preparing their application to the Supreme Court and continuing discussions with insurers.
